Prior to introduction of the Insolvency & Bankruptcy Code, 2016, the legal landscape for insolvency & bankruptcy was fragmented across numerous enactments i.e. the Sick Industrial Companies (Special Provisions) Act, 1985, Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002, the Recovery of Debts due to Banks and Financial Institutions Act (RDDBFI Act), 1993, and others.
The Code was introduced to address the lacuna and shortcomings in the insolvency laws in the country and provide a comprehensive, consolidated and effective framework for insolvency resolution and restructuring of defaulting companies with intention to ensure revival of such companies, maximization of assets and protection of interests of all stakeholders.
