Prior to the introduction of the Insolvency & Bankruptcy Code, 2016, the legal landscape for insolvency & bankruptcy was fragmented across numerous enactments i.e. the Sick Industrial Companies (Special Provisions) Act, 1985, Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002, the Recovery of Debts due to Banks and Financial Institutions Act (RDDBFI Act), 1993, and others.

The Code was introduced to address the lacuna and shortcomings in the insolvency laws in the country and provide a comprehensive, consolidated and effective framework for insolvency resolution and restructuring of defaulting companies with the intention to ensure the revival of such companies, maximization of assets and protection of interests of all stakeholders.

Our team actively represents financial institutions, lending institutions, banks, asset reconstruction companies, real-estate companies, multi-national and international conglomerates, infrastructure and manufacturing companies, home-buyers, resolution professionals, resolution applications and other key stakeholders.

Our team regularly represents clients before the Hon’ble National Company Law Tribunals all over India, National Company Law Appellate Tribunal and the Supreme Court in matters pertaining to insolvency and bankruptcy.
